1. Navyug Enterprises Privacy Policy

Navyug Enterprises created this website to provide information about its goods and services. The Navyug Enterprises Privacy Policy has been compiled to detail how users’ “Personally Identifiable Information” (PII) is being used online. As described in Digital Personal Data Protection Bill India, PII is information that can be used on its own or with other information to identify, contact, or locate a single person, or to identify an individual in context.

2. Collected Personal Information

The Navyug Enterprises website does not automatically collect user information. When asking to register to the corporate newsletter, users may be asked to enter their name, email address or other details to communicate news, events, and product information. When filling the contact form, users may be asked to enter their name, email address or other details to answer their enquiries about the company.

3. Use of Personal Information

Navyug Enterprises may use the information it collects to improve this website in order to better serve users and to allow the Company to better service users in responding to their customer service requests.

4. Data Protection

  1. Navyug Enterprises only provides information. The Company never asks for credit card numbers.

  2. This website is protected by an SSL certificate.

5. Orders, Prices And Payments Etc

  1. Any information and data on weight, measurement, capacity etc. whether in electronic or in any other form, regarding NAVYUG ENTERPRISES's products ("Products") are not binding unless explicitly referred to in an offer or written agreement. All technical data is provided subject to design modifications.
  2. Unless otherwise agreed in writing the Buyer shall make payment net cash, in the currency that the order confirmation is made, in advance prior to NAVYUG ENTERPRISES’s shipment. Any overdue payment exceeding two (2) weeks entitles NAVYUG ENTERPRISES to cancel the contract by notice in writing to the Byer. In case of such cancellation the Buyer is obliged to return the Products immediately at its own cost and on its own risk.
  3. NAVYUG ENTERPRISES is entitled to request adequate security for any outstanding part of the purchase price until the purchase price has been fully paid. NAVYUG ENTERPRISES is entitled to cancel the purchase if adequate security, in the opinion of NAVYUG ENTERPRISES's, is not presented immediately upon such request.

6. Delivery

Unless otherwise agreed in writing, all Products are send from NAVYUG ENTERPRISES's warehouse. NAVYUG ENTERPRISES is entitled to make delivery by instalments.

If the Buyer fails to accept delivery at the delivery time of any shipped Products (Shipment), NAVYUG ENTERPRISES may at its option sell the Shipment for the account of the Buyer and the Buyer shall be liable for all costs and expenses incurred by NAVYUG ENTERPRISES and the difference between the proceeds of sales and the Buyer's purchase price.

The Buyer shall inspect the Shipment immediately upon delivery and shall within seven (7) working days from receipt of the Shipment in the Buyer's warehouse notify NAVYUG ENTERPRISES of any matter or thing by reason of which the Shipment is not in accordance with the contract. If the Buyer shall fail to give such notice within said period, it shall conclusively be deemed that the Shipment with regard to quantity, number, weight and volume is in accordance with the contract and that the Buyer shall have no right to reject the Shipment.

7. Transportation And Packaging

All quotations are non-progressive unless otherwise has been agreed. NAVYUG ENTERPRISES will handle packing and delivery of Products to the Buyer. Transportation, handling fees and insurance will be charged in accordance with NAVYUG ENTERPRISES's rates prevailing at the time of delivery.

Any delivery date specified by NAVYUG ENTERPRISES is an estimate only and is not of the essence of the agreement and NAVYUG ENTERPRISES accepts no responsibility for delay howsoever caused.

8. Dangerous Goods

To be allowed to transport products that are classified as dangerous goods according to Law (2011 and Central Motor Vehicles Rule, 1989) certain rules must be followed.

  1. The products must be sent in a separate consignment.
  2. The products are packaged in type-approved packaging. This means that the packaging must meet certain design and test requirements in order to be used.
  3. An additional fee will be applied.

9. Return And Withdrawal Right

The Buyer has a period of thirty (30) days after the receipt of the goods to withdraw/return goods.

Parts must be returned unused in original packaging and the consignment shall be duly packed.  In the event of missing or damaged original packaging, a reduction in value takes place. Impairment is assessed on a case-by-case basis.

 Shipment costs and responsibility for the transport risk are the Buyer’s responsibility. 

 Upon return, a fee of fifteen percent (15%) will be discounted from the refund.

 After receipt and control of the returned goods, NAVYUG ENTERPRISES will contact the Buyer to agree on the amount to be returned.

10. Guarantee

This warranty policy applies to all spare parts and components sold by NAVYUG ENTERPRISES to it’s customers.
The obligation under this warranty is limited to reimburse the Buyer an amount equal to the purchase price, or repair or replace the faulty product of the purchased NAVYUG ENTERPRISES part or component found to be defective upon examination by Navyug Enterprises. It is the responsibility of the customer to see that all parts and paperwork are submitted for the claim. Customer must submit all claim charges, with the initial request, for warranty consideration.

All NAVYUG ENTERPRISES parts and components are warranted to be free from defects in materials or workmanship under normal use and service.

 It is understood that the end user or mechanic has an ongoing responsibility to examine a part as to its suitability to the repair undertaken. It is expected that all parts will be installed by a professional mechanic with experience and according to manufacturer’s installation instructions.

The guarantee is subject to the following conditions:  

  1. The Buyer services and maintains the Product according to the manufacturer's recommendations. 
  2. The Buyer has not carried out any repair, alteration, process, operation or treatment to the Products without NAVYUG ENTERPRISES's written consent.
  3. This warranty does not apply to any damage that is the result of rust, corrosion, or prolonged or improper storage.
  4. This warranty does not cover charges for fuel or lubricant usage, rental costs of any type, removal from or reinstallation of the product, or excessive time necessary to gain service access.
  5. As pointed out in (A), certain parts may need to be replaced due to wear and tear. Since these parts are consumed at varying rates, replacement is based on the operation and condition of your vehicle and on fixed schedules under normal operation and use of your vehicle. These items include, but may not be limited to, the following list: filters, fuses, belts, brake pads, brake rotors, wiper blades, shock absorbers.
  6. This warranty does not cover other incidental or consequential expenses including loss of use of the engine, loss of income, or inconvenience.
  7. NAVYUG ENTERPRISES is not responsible for failures resulting from any replacement part or component which has been subject to misuse; negligence; inadequate lubricant or coolant; under filling; overloading; lack of proper maintenance; or accident. NAVYUG ENTERPRISES is not responsible for the failure of any part that has been altered or repaired in anyway which in judgment of NAVYUG ENTERPRISES might affect its stability or reliability. NAVYUG ENTERPRISES is not responsible for failure resulting from improper installation, repair procedures, alteration or misapplication of parts.
  8. For NAVYUG ENTERPRISES parts, liquids and fuel must be used following manufacturer´s recommendation. Liquids and fuel must be used from sources there no contamination exist. 

All requested information from NAVYUG ENTERPRISES is required to be submitted to the NAVYUG ENTERPRISES within 5 days of submiting your claim. Request by NAVYUG ENTERPRISES of return of part(s) they must be returned within 10 days otherwise claim is rejected. 

If claim is denied, questions, comments and appeals regarding the outcome of the claim are required to be submitted in writing within 10 days. If no appeals requested from customer in that time, the claim part(s) will be scrapped at NAVYUG ENTERPRISES.

No person, distributor, agent, employee or company is authorized to modify or extend the terms of these warranties.

Revision 2023-March: This warranty policy is valid until further notice.

11. Limitation Of Liability, Indemnification

NAVYUG ENTERPRISES shall not be liable in damages of any form or nature, whether direct or indirect, consequential or incidental, for defective Products or any other failure to fulfill its obligations under this agreement, except in case of gross negligence, willful misconduct, death or personal injury. The Buyer acknowledges and agrees that, with the exceptions in the preceding sentence, its rights under the guarantee provisions in Article 4 above comprise the Buyer's exclusive remedy.

In the event any third party, who has purchased Products from the Buyer, is awarded damages from NAVYUG ENTERPRISES under any product liability law, the Buyer shall fully indemnify NAVYUG ENTERPRISES for such damages and for NAVYUG ENTERPRISES's reasonable costs in relation thereto, unless the damage in question was due to NAVYUG ENTERPRISES's gross negligence. NAVYUG ENTERPRISES will give the Buyer prompt notice of such claim and invite the Buyer to participate in NAVYUG ENTERPRISES's defence and any negotiation for a settlement with such third party.

12. Intellectual Property Rights And Information

NAVYUG ENTERPRISES may without notice make any change to the specification of the Products. If Products are manufactured or any process is applied to the production at the request of the Buyer, the Buyer shall fully reimburse NAVYUG ENTERPRISES for any and all costs and damages that might occur as a result of the specification or application of process infringing third party intellectual property rights.

 The property of all documents and tooling prepared, manufactured or supplied by NAVYUG ENTERPRISES and all intellectual property rights therein shall vest in and remain with NAVYUG ENTERPRISES.

 The Buyer shall immediately notify NAVYUG ENTERPRISES of any claim of a third party alleging that Products delivered by NAVYUG ENTERPRISES infringe intellectual property rights. The Buyer shall upon NAVYUG ENTERPRISES's request give NAVYUG ENTERPRISES the sole authority to defend or settle the case, provided always that NAVYUG ENTERPRISES undertakes to do so at its own expense.

 If it is held that Products delivered under this agreement have infringed third party intellectual property rights, NAVYUG ENTERPRISES shall, at his own expense, and at NAVYUG ENTERPRISES's option, obtain for the Buyer the right to continue using the Product, replace or modify it so as to become non-infringing or, in exchange for the return of the Product, reimburse the price of the Product.

 The Buyer is not entitled to any other remedies, than those set out above, in relation to NAVYUG ENTERPRISES's Products infringing third party intellectual property rights.

13. Buyer's Obligations

The Buyer shall obtain all necessary permits and certificates from any public authority or other regulated body to enable NAVYUG ENTERPRISES to comply with all statutory requirements and regulations.

The Buyer shall maintain strict confidentiality in respect of the business affairs, documents, and intellectual property rights of NAVYUG ENTERPRISES's and shall not disclose or use the same except as necessary for the performance of the contract.

14. Retention Of Title

Products delivered shall remain the property of NAVYUG ENTERPRISES's until the Product’s Payment have been paid in full.

15. Inevitable Accident Or Act Of God

If either party is prevented from performing its obligations under this agreement due to inevitable accident, the other party may not introduce any sanctions by reason thereof. However, if the hindrance regards the Buyer's possibility to carry out payment, NAVYUG ENTERPRISES is entitled to withhold delivery of any Shipment until payment has been effected. If the hindrance to effect payment lasts for more than four (4) weeks NAVYUG ENTERPRISES is entitled to cancel the purchase.

The term " inevitable accident " means in this agreement that the performance under the purchase contract is prevented, aggravated or  delayed  due to war, rebellion or riot, mobilization or unexpected call for military service of similar dimensions, requisition, seizure, exchange restrictions, export- or import restrictions, general scarcity of merchandise, shortage of transportation, labour conflict, restrictions on fuel and power, fire, flood, earthquakes, faulty or delayed deliveries from sub-contractors due to above causes, as well as any other circumstance beyond the control of the party.

The party claiming to be affected by inevitable accident shall notify the other party in writing without delay on the intervention and on the cessation of such circumstances.

16. Governing Law And Disputes

This agreement and any disputes here under shall be governed by Indian law.

Any legal action relating to this agreement and all legal relationships associated with it shall be decided by District Court of Delhi, India as exclusive jurisdiction of first instance. However, NAVYUG ENTERPRISES is always entitled to bring a claim for overdue payment to the local court or enforcement service where the customer has its legal domicile.

17. Cookies

Cookies are small files that a site or its service provider transfers to a user’s computer's hard drive through their web browser that enables the site's or service provider's systems to recognize the browser and capture and remember certain information.

Browser settings allow the user to receive notifications about cookies or disable them. Since every browser is different, the correct way can be found within the browser’s Help Menu.

If cookies are disabled, some of the features may not function properly.

18. Third-Party Disclosure

Navyug Enterprises does not sell, trade, or otherwise transfer Personally Identifiable Information to outside parties. This does not include website hosting partners and other parties who assist the Company in operating this website, conducting business, or serving users, so long as those parties agree to keep this information confidential. Navyug Enterprises may also release information when its release is appropriate to comply with the law, enforce the site policies, or protect user rights, property or safety.

Navyug Enterprises does not include or offer third-party products or services on this website.

19. Personal Account and Notifications

Users can have personal accounts.

Users will be notified of any Privacy Policy changes on this Privacy Policy Page.

Should a breach of data occur, Navyug Enterprises will take the following actions:

Notify the users via email within 7 business days

Notify the users via in-site notification within 7 business days

20. CAN SPAM Act

The CAN-SPAM Act is a law that sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have emails stopped from being sent to them, and spells out tough penalties for violations.

Navyug Enterprises may collect user emails to:

Send information, respond to enquiries, and/or other requests or questions;

Send additional information related to products;

Market to the Company’s mailing list or continue to send emails to clients after the original transaction has occurred.

In accordance with CANSPAM, Navyug Enterprises agrees to the following:

Not use false or misleading subjects or email addresses.

Identify the message as an advertisement in some reasonable way.

Include the physical address of our business or site headquarters.

Monitor third-party email marketing services for compliance, if one is used.

21. Miscellaneous

Either party's failure to enforce breach of this agreement or to exercise its rights due to such breach shall not be deemed a waiver of such rights to enforce any future breach of agreement.
